Terms of Service

1. Acceptance of Terms

By accessing or using the Maazi platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

"You" refers to the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Description of Service

Maazi is an AI-powered hiring platform designed to replace traditional recruiting workflows. The Service enables:

• Companies to create roles and define hiring criteria through an AI-assisted interface.
• AI-generated candidate screening journeys tailored to each role.
• Candidates to complete screening stages, including text-based and video responses.
• AI-powered scoring and ranking of candidate responses to assist hiring managers in their evaluation.
• Hiring managers to review AI-scored results and make final hiring decisions.

Maazi operates on a zero-ghosting principle: every candidate who applies receives a response, regardless of outcome.

3. Account Registration

To use the Service as a hiring manager or company administrator, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and notify us immediately of any unauthorised access.
• Use only one account per person. You must not share your credentials with others.
• Be at least 16 years of age to create an account and use the Service.

Account authentication is managed through Clerk, our authentication provider. By creating an account, you also agree to Clerk's terms of service as they apply to authentication.

4. Subscription & Billing

Maazi offers paid subscription plans, including Starter and Growth tiers. Details of features and pricing for each tier are available on our pricing page.

• All payment processing is handled by Paddle, our merchant of record. Paddle's terms of service apply to all payment transactions.
• Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
• Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of that period.
• No refunds are provided for partial billing periods or unused portions of a subscription.
• We reserve the right to change pricing at any time. We will provide at least 30 days' notice before any price change takes effect.

5. Acceptable Use

You agree not to use the Service in any manner that:

• Violates any applicable local, national, or international law or regulation.
• Involves submitting false, misleading, or fraudulent information.
• Attempts to circumvent, manipulate, or game AI scoring or evaluation results.
• Uses the platform to discriminate against candidates on the basis of race, gender, age, religion, disability, sexual orientation, or any other legally protected characteristic.
• Involves scraping, reverse-engineering, decompiling, or copying any part of the platform or its underlying technology.
• Uploads malicious content, malware, or otherwise attempts to compromise the security or integrity of the Service.
• Uses the Service to send spam, unsolicited messages, or bulk communications not related to legitimate hiring activities.
• Exceeds rate limits or abuses API access in a manner that degrades the Service for other users.
• Sublicenses, resells, or grants third-party access to the Service without our prior written consent.

6. Candidate Terms

Candidates access the Maazi platform through unique links shared by hiring companies. The following terms apply specifically to candidates:

• No account registration is required. Candidates access screening stages via secure, token-based links.
• Before beginning any screening, candidates are informed that their responses will be evaluated by AI and consent to this evaluation.
• Candidate responses, scores, and summaries are shared with the hiring company that initiated the screening.
• Candidates may request deletion of their data at any time by contacting hello@maazi.io.

7. AI Features & Limitations

Maazi uses artificial intelligence to power core features of the Service, including scoring candidate responses, generating summaries, ranking candidates, and drafting communications.

• All AI outputs are recommendations only. Human hiring managers are responsible for making all final hiring decisions.
• We do not guarantee the accuracy, completeness, or freedom from bias of any AI-generated output.
• We use commercially reasonable efforts to maintain and improve the quality of our AI systems.
• AI features may be updated, modified, or replaced over time as we improve the Service.

8. Intellectual Property

The Maazi platform, including its software, design, branding, documentation, and all related intellectual property, is owned by Maazi. All rights not expressly granted in these Terms are reserved.

• Your company data, job descriptions, and candidate data remain your property.
• You grant Maazi a limited, non-exclusive licence to process your data solely for the purpose of delivering the Service.
• Role templates provided by Maazi are licensed for your use within the platform. You may not redistribute, resell, or extract templates for use outside the Service.
• You retain full ownership of any screening questions, configurations, and custom content you create within the platform.

9. Data & Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data.

• Companies using Maazi act as data controllers for candidate data they collect through the platform. Maazi acts as the data processor.
• A Data Processing Agreement is available for companies that require one for GDPR compliance.
• You are responsible for ensuring you have a lawful basis to process candidate personal data through the Service, in accordance with applicable data protection legislation.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.

• We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• We do not warrant that AI-generated outputs will be accurate, complete, or free from bias.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• Our total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the total amount you paid to Maazi in the twelve (12) months immediately preceding the event giving rise to the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or theory of liability.
• This includes, without limitation, damages for lost profits, lost data, loss of goodwill, business interruption, or any other commercial damages or losses.

12. Indemnification

You agree to indemnify, defend, and hold harmless Maazi, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service or violation of these Terms.
• Any claims made by candidates or third parties in connection with your use of the platform.
• Your breach of any applicable law or regulation in connection with your hiring activities.

This indemnification obligation does not apply to claims caused solely by Maazi's negligence, wilful misconduct, or breach of these Terms.

13. Termination

• Either party may terminate these Terms by providing 30 days' written notice to the other party.
• We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users.
• Upon termination, your data will be retained in accordance with our data retention policy as described in our Privacy Policy.
• You may export your data at any time before termination takes effect. We recommend doing so prior to the end of your notice period.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer based in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email or through an in-app notification.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
